What Is a Wage Claim?
When a company files for bankruptcy, employees who are owed wages, benefits, or PTO become creditors. A wage claim is your formal declaration to the bankruptcy court stating what the company owes you — and why it owes you.
Filing a claim does not guarantee payment. But not filing one almost certainly means you collect nothing. The claims window is open for a limited time.
What You Can Claim
Former Spirit flight attendants may be owed:
- Unpaid wages — hours worked for which no payment was received
- Final paycheck — wages earned in the final pay period before termination
- Accrued PTO — vacation or personal time that was earned but never paid out
- Uniform allowances or expense reimbursements that were promised and not paid
How the Process Works
Spirit Airlines filed for Chapter 11 bankruptcy protection. The court appointed a claims administrator — currently Epiq Bankruptcy Solutions — to manage the creditor claims process.
Steps to file:
- Gather documentation: pay stubs, final pay statements, any HR correspondence
- Calculate the exact amount owed, broken down by type (wages, PTO, etc.)
- Access the claims portal at Epiq and submit before the bar date
- Keep a copy of your filed claim and any confirmation number
Protecting Your Privacy
The bankruptcy claims portal is a court record. If you are asked to enter your Social Security Number, redact all but the last four digits before uploading any document. Full SSNs in bankruptcy filings are a known identity theft risk.
